US judge throws out Texas ban on drag acts, calls it unconstitutional

A new Texan law limiting public drag performance has been ruled unconstitutional on speech, by a federal judge and permanently forbade enforcement of it. U.S. District Judge David Hittner wrote in the 56 page ruling: “This is no different than a person’s opinion on certain comedy or genres of music, but that alone does not strip First Amendment protection. Not all people will like or condone certain performances.” Hittner ruled that the Texas law was discriminatory and improperly vague. He found that Senate Bill 12 “impermissibly infringes on the First…

Texas anti-drag bill blocked again by federal judge

A US judge has extended a temporary order preventing the application of Texas’ law limiting drag performances.   US District Court Judge David Hittner of the Southern District of Texas extended a temporary restrainer order for two weeks which prevents the enforcement of Senate Bill 12.  Senate Bill 12, which restricts “sexually oriented performances” was set to go into effect on 1 September and was originally passed back in April. Bill 12 aims to ban performances on public property where a performance will be viewed by attendees under the age of…

Texas governor Greg Abbott signs bill banning gender-affirming care for trans youth

Texas has become the 18th state to ban gender-affirming care for trans youth. Over the last few years, the state’s Republican governor Greg Abbott and his political allies have made it their mission to attack the rights of trans people.  Back in February 2022, Attorney General Ken Paxton released an official opinion denouncing gender-affirming care. He also said that the life-saving treatments should be considered “child abuse”. Shortly after his harmful statement, Abbott released his own transphobic letter – which ordered the Texas Department of Family and Protective Services (DFPS)…

Texas judge orders censored LGBTQ+ books to be returned to public libraries

A Texas federal judge has ordered public libraries in Llano County to return an array of previously banned LGBTQ+ books.  Back in April 2022, seven residents filed a lawsuit against county officials after they forced libraries to either remove or restrict various books with queer and racial themes. Some of the titles removed included Caste: The Origins of Our Discontents by Isabel Wilkerson, Being Jazz: My Life as a (Transgender) Teen by Jazz Jennings, and They Called Themselves the K.K.K.: The Birth of an American Terrorist Group by Susan Campbell…

Texas lawmakers continue targeting LGBTQ+ people with new bills

Lawmakers in Texas have introduced 17 anti-LGBTQ+ bills for 2023. Content warning: this story includes topics that could make some readers uncomfortable. A range of the bills have targeted LGBTQ+ people since Monday (14 November), which marked the beginning of when legislators could submit new bills for the next session. Suggested revisions to child abuse law would criminalise parents and hospitals for helping children access gender-affirming healthcare as felony abandonment of a child. Punishment for this can be up to 20 years in prison. There is also a move to…

US midterm elections: LGBTQ+ candidates make historic wins

It was a mixed night for the LGBTQ+ community in the US midterm elections, with some historic wins for newcomers, but also victories for Republican candidates who have already enacted anti-LGBTQ+ legislation in their states. With a number of LGBTQ+ issues on the line, from the ‘Don’t Say Gay’ bill to trans inclusion in sport, voters did take to an overwhelmingly queer ballot as a record number of LGBTQ+ candidates stood for office, but much was at stake. Here, we’ve summarised some of the biggest wins and losses for the…

Texas judge expands temporary order blocking investigations into families of trans youth

A Texas judge has expanded a statewide injunction blocking harmful “child abuse” investigations into parents of trans youth. Back in February, Attorney General Ken Paxton released an official opinion denouncing gender-affirming care. He also said that the life-saving treatments should be considered “child abuse”. Shortly after his harmful statement, Governor Greg Abbott released his own transphobic letter – which ordered the Texas Department of Family and Protective Services (DFPS) to start investigations into parents of trans youth. “Because the Texas Department of Family and Protective Services (DFPS) is responsible for…

Employers in Texas no longer required to cover HIV prevention drugs

A federal judge in Texas stated that employers should not be forced to cover PrEP medication if it violates the company’s religious beliefs. The ruling concluded that providing the drugs makes company owners “complicit in facilitating homosexual behaviour”. US district judge Reed O’Connor made the judgement on 7 September. He ruled in favour of Braidwood Management, a Christian-owned company based in Texas, which argued it was not required to cover the costs of two PrEP drugs, Truvada and Descovy. Legal experts, such as Chris Geidner, noted that O’Connor has a…

Lin-Manuel Miranda reacts to Texas church’s “illegal” Hamilton performance: “Now lawyers do their work”

Lin-Manuel Miranda slammed The Door church over their unauthorised and homophobic version of Hamilton. At the start of August, the South Texas-based church went viral on social media after they hosted a performance of the famous historical musical. However unlike the source material, the church’s heavily edited show included references to Jesus and Christianity. The conservative performance then concluded with an anti-LGBTQ+ sermon by The Door pastor Victor Lopez – which featured him comparing homosexuality to drug addiction. “Maybe you struggle with alcohol, with drugs, homosexuality. Maybe you struggle with…

Texas judge issues another temporary order blocking the governor’s anti-trans directives

A Texas judge has blocked the state’s harmful “child abuse” investigations into parents of trans youth. On 8 June, Adam and Amber Briggle, two other anonymous families and the LGBTQ+ organisation Parents, Families and Friends of Lesbians and Gays (PFLAG) filed a lawsuit against DFPS and Governor Greg Abbott. The legal documents were filed due to Abbott’s harmful anti-trans directives that he issued in late February – which called on the DFPS to investigate the parents of trans youth undergoing gender-affirming care. The court filings revealed that the governor’s horrific directives…
